If I were you, I'd call H&R Block or any of the tax services to find out the rules regarding claiming your son. I know only one of you can do it, but you would think it would be whoever has primary custody. A tax professional should be able to answer your question, free of charge. Sorry I'm not much help :(

Not a tax professional, but I do belies that you have to prove that you provided the majority of the child's upkeep for the tax year in order to claim them.
I definitely would recommend seeking out a tax professional to answer that question definitively and give you ideas on how to rectify the situation.
