My daughter is a straight 4.0 student, she is very actice in sports, very well liked by all and a social bug.
There is this boy that has failing grades, very bad mouth and hangs out with not so good friends. He is after my daughter 24/7. How do I get her to see he is bad and not good for her? Please help!!!!

So, have you actually interacted with the boy, or are you basing your assumptions of him on pure observation and hearsay?

If your daughter is interested in someone, no matter whether he's the heir to the Rockefeller fortune or the kid from the "wrong side of the tracks", it behooves you, as her parent, to interact with the person and make your own determination about him, before you arbitrarily deny all contact.

And yes, birth control is a good idea ;-)

Well, does she like him back? If so, you can her she has all the time in the world for boys when her education is done. A guy that doesn't care about himself or his education is really no good. I can't say that will solve everything; I mean if there's puppy love involved, there's really no stopping it. Also, at least once in her life, she'll want to date a bad boy. I would get her on birth control asap IF she takes a liking to him before anything could happen.
