My son's biological father (my ex boyfriend) is threatening to sue for custody of my son whom I currently have possession of. Neither of us have custody rights (we are both on the birth certificate), and we had been switching off taking care of him on an every-other-week basis. Until recently, this was fine (more or less).
My son's father (I'll call him "D") has a history of drug-use and "had been" involved with shady types. He is a registered felon. The only reason I shared my son with him is that he had supposedly been clean for over a year. D's dad had confirmed this, and I had reason to trust him.
However, about 2 months ago D was arrested for various charges including possession of a weapon by a felon. Of course, he got away with the charges and his dad bailed him out (I also have reason to believe he was high on pills while in my son's presence). In the meantime, I took possession of my son and have not returned him.
I need desperately to obtain full custody of my son, but now D is threatening to sue for custody with the help of his dad (D is as broke as I, but his father has money). I'm currently seeking employment and have no money for court fees. I have no records, no harmful addictions, I provide for my 2 kids (I have a 10 year old daughter also) and they are both enrolled in school near me. His father lives almost 2 hours away.
No lawyers in my county even offer free consultations. DSS has been less-than helpful. What can I possibly do? Thanks.
