Last yr i bd told me i was signing joint custody papers he lied to me n told me it wss only joint.. I signed the papers not reading them so 1 yr later i told him i was coming for my daughter he told me flat out no.. So he added that she was residential and he was 2 file her the next years to come.. Also not to mention he gt to file her previous years on his taxes even tho he didnt take care of her. But my thing is he been n her life 2 years out of 8 in he does this 2 me... I have proof she been with me and also we agreed verbally that she was only there temporarily.. Any suggestions

I went and file a motion... Now just waiting 4 the judge 2 review and approve us a court date

Yes the paper gt notarized n yes i didnt ready the paperwork there wasnt a court date i just found out it was voluntary... The lawer told me if i can find any text messages to them agreeing that she was only there temporary he would rule n my favor... The bottom line is i never should of signed anything without reading it first.. So therefore i have 2 find my way out of this mess...

I am trying to get phicaly coustdy of my 16month old nephew. He is in a foster home at the moment but He has been in my home 50 % of the time . My partner and I can more then provide for him we would like him with us full time . Any tips mom's?

Sarah, you have a good point. Lemarie, were any of these people involved?

Ultimately, though, the bottom line is, you need to file, because even if this wasn't a legal document, then you have no proof that you have any kind of legal custody. Without that paperwork, you won't be able to get assistance getting your child back.

Here is what I find very fishy about this post.
When you sign a legal document that will become a binding arrangement, you have to get it notarized. Otherwise, he could have signed you name for you and claimed he had rights to the kids.
Also, a custody modification has to get signed by a judge, so when you went to court for this a judge would have said that custody of the minor children was being voluntarily given to the father. Something is just not adding up.
The only time I ever signed a document without reading it was when we bought our home and our lawyer sat next my hubby and I and said; sign, initials, date on dozens of pages. That would be the extent of it and if you have ever bought a home, you know what I am talking about.

I agree with Jodi. It doesn't matter what he said they were, you signed them without reading. You have learned a valuable lesson.
Get yourself a lawyer and go to court.

It's not fraudulent if you made the choice to sign without reading. Sorry, the law won't agree with you on that one. Ignorance is not an excuse, unfortunately.

I understand now ppl will mess up ur life n order 2 makes theirs happy... Hopefully the judge will c it my way.. Hes already paying for 2 other kids child support so i kno this was his way out.. Now i cant enjoy my daughters life.. Not because im on drugs not because i negelant with her not because i put her n harms way... Just so he wont pay c.s.. Ima fight 4 my baby if it takes my last strength 2 put into this..


I kno i was screwed thats fraudulent even tho i signed.. He lied about what they where...IM PRAYING

And he has proof you signed the papers. You GAVE him the right to do this. Sorry, but you should NEVER sign a legal document without reading it. You now can't complain that you were screwed over. You weren't. You signed it.

If you want the situation to change, you are going to have to file new orders.
