I want the father of my son to stay away!

I'm having an induction on 10/6/14 and as the days get closer, I'm fearing for the life of me and my unborn son because I have been getting word that my ex is going to try and get custody of my son and try and take him. He also has said that he will put up a fight with the hospital if anyone tries to intervene if he comes and visits me there. I don't want him there! He's so mean and he's abusive. I don't want him to touch my baby. help.

You have the right to ask him not to visit you in hospital if you don't want him there, however he does have a right to see his child and a right to file for visitation at the very least. That's not your decision to make.

I would suggest that if you genuinely fear for your life because of abuse, you put together your evidence and file for a protection order. However, unless you have evidence that he has threatened your child;s life in some way, I highly doubt he will be prevented from having contact with your child. Get yourself a lawyer and make sure you file for custody orders, but remember, he will get visitation (even if only supervised) unless you have absolute documented proof that your child's life is in danger. As he should, because fathers have rights, just as children have a right to a relationship with both parents.

Have you filed police reports to document the abuse?

When you are at the hospital YOU get to control your visitors... but he is the father and legally and morally he does have a right to a relationship w/ his son... just as much as you do.

If you have solid evidence of the abuse you may have a good shot at him getting supervised visitations in court... but then again, maybe not since the abuse has been against YOU... not the child (yet). It depends on your lawyer and the judge.

If I were you I would start calling lawyers now... and get copies of the police reports if you've made any. Good luck!
