I went to court to get my childs father put on childsupport. They did not enforce a visitation agreement because we were getting along at the time. But, he was entitled to pay me childsupport every month. We were never married and he's not on the birth certificate but the judge waived the paternity test because I told him he was the father and he agreed that he was the father.. Can I legally take my son out of state without getting kidnapping charges?

Not good. In that case do what ever you have to do to get out. If there's no custody order or anything it shouldn't be a big deal but I'd still get some legal advice so you know where you stand.

We were getting along at the time we went to court. Now, he has battery and criminal restraint charges against him cuz he beat me up in front of his son and went to jail. Now hes doing everything in his power to screw me over so I cant leave to my familys with his son but I feel that its necessary to do cuz hes going crazy :(

If you get along and he pays child support why would you want to take the child out of state that just going to undo everything. I'd suggest this is something you need to speak to the father about. Otherwise seek legal advice.
