Is it ok for my kids father to claim them on income taxes even though they live with me nd he pays child support

What does the court order say? Some court orders to allow for the parents to alternate years or one parent claims one child while the other parent claims the other... or similar arrangements.

If you do not have a court order and they live w/ you more than 6 months of the year... it is your right (typically) to claim them. If he files first and claims them though there WILL be an audit... so I would speak to an IRS agent and/or a lawyer to find out exact details in your situation.

You are divorced, correct?..and...who has the legal rights to claim them ?.... If you have the legal rights to claim them but your ex-husband claimed the kids in his tax (without your authorization) you can take him to court-IRS, and he will have to pay back whatever $$$$ was his refund. Then you can claim your kids on your taxes.
