Is it legal or not.

My husband and I have been separated for about 3-4 months He is taking my 5 year old and my 15 year old to Virginia and leaving my 17 year old behind for 10 long nights not supervised and no family close. We are in a custody battle so I cannot see me kids at this time. I was wondering if it is legal or not. I just think 10 long days is too much for a 17 year old to be home alone. Is this legal?

In the US, most states allow kids over the age of 16 to be on their own without supervision for a period of time. If the 17 YO is self sufficient, they will be fine. At 17, my eldest stayed home for a fortnight while we and his younger brother and grandmother went to a family funeral. He had work, and wasn't that close to the uncle that passed, and he was fully self sufficient. He didn't even feel left out...mainly because we chatted with him every evening, and he had full access to get ahold of us if necessary.
What is the reason that the 17 YO is staying behind? Work, perhaps?
I don't even want to touch on the 'custody battle and I can't speak to my kids' part, because that indicates that there are other familial issues involved, if you are not allowed contact at this point.
As far as legality, yes, it is legal, as long as the 17 YO does not have a medical condition requiring constant care.

Why can't you see the kids? I don't understand why the 17 year old can't stay with you.
