Kindergarten bully at recess

My son is getting excluded from a group of friends because one boy tells him he can't play with them. During recess in Kindergarten, they play a type of tag game (running and chasing) and my son loves it. All his friends play together. Now, one boy is telling him he can't play with them. But the next day, he tells him he can play. This has been happening on and off for a couple months. At first, my son would cry as soon as he got in the car but I have been helping him with this at home and now he doesn't cry but says he gets a "little sad" when he can't play with his friends. The teacher knows this is happening and has talked to the kid once. How do I get this kid to stop telling my son that he can't play with this group of friends?

What Jodi said. You need to teach him to stand up for himself, or he'll be a target his entire life

In addition to talking to the teacher about it, your son needs to develop some resilience. Teach him to tell the boy that he can't tell him what he may or may not do and that he IS playing today. Or teach him to let the teacher know when this happens.
