I want to know if my child has the rights to his father's assets as long she has her last name.

If he is listed as her father on her birth certificate, she automatically would qualify for benefits like social security if he were to die before her 18th birthday. As far as his personal assets, nothing can guarantee a right to that except his will. That would be the case whether or not she had the same name.

The only assets that anyone has access to of anyone else's are those that are given or willed to them upon the death of the first party.

If you are trying to 'get' something that your ex has, that you think you're entitled to, perhaps you should determine if you really are entitled to it.

Do you mean to ask whether you have the right to file for support if the child bears the last name of her father?

There are so many other factors that need answering here.
In short, just have his last name doesn't give her anything. It would also depend on his will.

Why is this your only concern? Does the child see her father? If the child isn't in her father's life, then she is likely to get nothing unless a will specifies it.

You will have to have legal documentation stating what assets of her father's she gets. Just having his last name means nothing.
