Moving out of State

Dh and I have full custody of our 3 1/2 year old and have had full custody since he was 18 months old. BM gets 30 hours a week ( two 3 hour visits Tues & Thurs and one 24 hour overnight on weekend 6pm-6pm. DH has currently gone through another lay off as a coal miner and we are considering moving to FL to live with my parents who could help financially and as a support system when caring for our son. Would the court allow us a move if we took it to court? We do not get along with BM, and she never seems to be able to handle SS very long. (Every weekend overnight we get phone calls about SS saying he's sick or being mean, we've even picked him up early quite a few times BC BM couldn't handle it) Our current state is Ohio.

You will probably be permitted to move but another sort a visitation will get ironed out and you may be responsible for the cost of transportation. Have you discussed it with BM?

He will need to go to court and get the visitation order modified. He may be required to provide transportation costs for BM to continue visitations and you will likely need to prepare for her having fewer visitations, but for longer periods (like 1-4 weeks). Those types of decisions will be up to the judge... though it's possible that your husband and his ex could come up w/ a mutual agreement and the judge will just sign off on it.

There's no way any of us can legitimately predict what WILL happen though.

Even if she agrees you'll have to go to court to get the order amended anyway.

No we haven't mentioned it yet do to we're still deciding. We know BM will object to if since she views SS as a check and power (she got caught still collecting cash assistance 6 months after losing custody) so we know we'd most likely have to take it back to court.

***Also*** SS is always fine after we pick him up, stating he just really missed us. BM remarried 8 months ago to a guy who's already been arrested twice (to our knowledge only twice) in the past 6 months for menacing and warrents.
