my child has been going to see her dad on the weekends for 10 years, recently over the past few years i have been having some issues with his wife and the things my daughter tells me. so very nice i asked him about these things and of course he was not aware because he lives in his building drinking and watching tv while his wife tends to my daughter and their two children he became very agitated and told me if i didnt like it he would see me in court. i have been her primary care giver for 10 years, he dont even have a drivers license, and he pays 100 dollars a month support and sometimes misses that can he take her away from me if i file custody?

Is there a court order in place already for custody, visitation, and child support? Since it's been 10 years I'm assuming there is, but I don't know for sure....



If you have custody already.... you won't lose it unless he can prove you unfit. If you don't already have custody and go to court now the judge COULD award joint custody unless you can prove him unfit... or you could get custody and he get visitations. That part really depends on the judge and where you are.
