When I first had my child, we lived together and he became not only verbally abusive but physically abusive. I only got the cops involved for the time he actually punched my front tooth out of my mouth. And it wasn't me that called it was my girlfriend, once I called her to come get me and my child. That was in 2011 and now that it is 2014< I have went back to him a couple months after the altercation , thinking that my child needed her mother and father to be in her life. Boy was I wrong, a year later in 2012 we got into the same altercation but the difference was our friends were around so we didn't get into him beating on me. In August 2012, I relocated to Atlanta, ga in the attempt to have a better life for me and my child with the support from my father. But my child's father put a restraining order on me which restrained me from taking my child with me to Atlanta. Presently he has primary residence of my child with me having 3months of visitation while I am living in Georgia. I went to court in March 2014, the judge told me that I will not be able to have more visitatyion with my child while in Georgia. therefore in April. I left my job, car and home in Atlanta to come back here to be with my child. And even though that I'm back here in Nj where the court has forced me to be and my child's father wanted me to be. I don't get to see my child only on every other weekend. He gives excuses about not having money and being too busy. He and my mother which doesn't have nthe best interest of anyone but herself are petitioning the courts for my child's father to have full custody of my child. This is not in the best interest of my child, because more than anything she wants to be with her mother which anyone can tell when she has to go with her father. My child wants to be in absolute control of me and my child. And since I wont comply I am a problem and he wants me gone. He is very bitter and resentful for want I have accomplished on my own and because I'm not looking for any help from him. I need resources and assistance in this matter. So if anyone can provide positive feedback in this matter would be greatly appreciated.

Well, you can't expect more that what the current court order states (or different to what the current court order states) until it is revised. He had every right to prevent you from taking his child out of state because that was never your choice to make. But it is unlikely he will get full custody if you are now back in NJ.

I have been back for about 3-4 weeks and no I haven't. I was trying to get myself together with a job and a place to live. I know he filed for court last Thursday but he hasn't received a court date yet.
