My daughter's father wants to terminate his parental rights

My daughter's father want to terminate his parental rights just because he doesn't want to pay child support. He also wants me to send him a petition saying that my husband wants to adopt my daughter. He was the one who sing voluntary for paternity and also child support. What should I do? any advice?

What you need to do is contact a family law lawyer in your area and see what the law says about parents terminating their rights. I have read on some posts here that though the father or mother terminated their rights or had that done for them they still had to pay support. So before he thinks he can just up and think he does not pay support you should check the law first.

thanks for your comment Dove. Of course my husband wants to adopt her, he has been there for her since she was 5 months. but he says since her Bio father is the one who wants to terminate w/ parental rights he should be the one who starts the process not us. I agree with my husband but bio father keeps saying that i need to send him that petition.

Does your husband want to adopt her? It sucks that her bio father wants to do this, but if he really doesn't want her and her stepfather does... that might be best for her for right now. You can ask bio father to keep you updated on contact info if she wants to contact him as an adult. I am a strong believer in a child being able to have a relationship w/ both bio parents, but a father that wants them IS much more stable than one that doesn't.
