My daughters father made a threat to hurt my daughter

my daughters father had made a threat over the phone and had threatened to hurt me and my daughter when I went to court yesterday the judge had made me give my daughter back to her father even after I had shown them the police reports and the domestic violence report. can the judge do that cuz all I am waiting on now is the order of protection against him I have also tried applying for emergency custody and now I just don't know what to do any advice would help me.

I guess it depends on what he said. If he has threatened to hurt you, then that has no bearing on the custody situation. If he specifically threatened harm to your daughter, and your order of protection includes her, then once that goes through, you have something to stop the visits. However, the judge sees that you DON'T currently have an order of protection, and you have to wait for the evidence for that to be heard by the appropriate court.

Yes, the judge can make that type of ruling. Do you have current custody orders stating that the father was supposed to have the child and you violated that? Do you have a lawyer? If not... you REALLY need to get one to help you through this.

If the order of protection goes through and it includes you AND your daughter... hopefully that will get her back to you soon. How old is your daughter? If she's old enough to speak (even just a little... they can do 'play therapy' too) I would have her in counseling w/ a therapist willing to testify in court.
