My ex lets my 16 y/o out all night?

My ex has my 16 (almost 17) y/o son Mon, Tues, Wed and allows him to stay out all night and doesn't call and ask about where he is. I do call his cell and asks him where he is and he tells me. My ex's excuse is that his parent's didn't allow him that kind of freedom at 16 and he heavily resents them for that (I feel he should be glad his parents were trying to keep him safe) and when I bring this up to him he says I'm being to strict with out son by not allowing him out all night and he resents his parents for not allowing him that kind of freedom. I feel that a 16 y/o out all night is a recipe for trouble. Our city used to have a curfew but the court took it down because some stupid parents decided to sue. I never will allow my children out this late until they are 18 because there is a big difference in the maturity level of a 16 year old vs. an 18 year old.

Generally, by the age of 16, the courts in the US will allow the kid to choose residency.

I personally don't feel a 16 YO needs to be out all night, but I'm not the kid's parent.

Unless the kid is in danger when he goes out, you cannot dicate how the other party parents the kid. So, as long as your kid understands that your rules and dad's differ, and you enforce your end, you're doing your part.

If its still going on during the school year, and schoolwork suffers, you may be able to revisit it then.

I'm not sure what advice you are after, but if this is not against the law, unfortunately there is very little you can probably do about it. Where I live, they won't even hear a case of custody or visitation for a 16 year old, so this is one you are going to have to discuss with your son with regard to the choices he is making rather than making it a battle with the ex.
