My ex took my children from me about 2 months ago, I was able to see them every Saturday until I told him I was taking him to court for full custody now he won't let me see them at all. Can he do this?

Given there is no court order, unfortunately, yes he can, BUT it won't look good for him in court if he has been denying you visitation because he will be seen to be interfering in the relationship the children have with you without good reason. Document everything, every attempt you make to see the children, every attempt to phone them, and every time he denies you and what is said. And get yourself a good lawyer.

Thank you Dove, yes it is my children that will hurt. I plan to take him to court for full custody. He has been mentally and physically abusive to me through our relationship and is only doing this to hurt me.

Unless he has some 'dirt' on you or you on him (abuse, drugs, criminal record)... MOST courts like to go with 50/50 custody whenever possible. Document EVERYTHING and take his butt to court. Unless he has VERY good reason to withhold the children from you he is hurting them by not letting them see you and the court won't like that.



Document, get a good lawyer, and good luck!!

Thank you for your response Jodie. This is what I thought. He is blackmailing me so I don't go to court which is unfair on my children.
