Sorry that i'm not including commas nor periods in questions but my keyboard got wt n it does keys don't work so i'll be using Enter key as comma or period

My question is
what do I as a mother who got married to an amazing soldier and husband and father to my children 3years ago can do about getting set for him:husband to adopt my first child that i had out of wedlock when in highschool
My husband has been raising and providing for my son since a couple months before we even got married n he loves him as his own

my son's biological father hasn't really been there for my son
he only wants to visit him when ever he feels like it honestly
and just recently he told me that he wants to sign off his parental right away n let my husband adopt my son

so the other question is
where do i go or how do i get the documents that i need so that my ex can sign off rights

Or how do i do it
I've been on several internet sights n non have been helpful so far

Actually, you have to go through a lawyer. A family law lawyer knows the ins and outs of this and can guide you the best ways to go. if you do it on your own, you might miss critical paperwork, you might do the paperwork wrong, you might miss deadline dates if you do not ask about them and so on. Its a process.

Lori, no disrespect, but in some states you have to notify the other parent and get them to sign forms before a legal adoption of a step parent can take place. Also it depends on if there were child support orders in place at the time the other parent skipped out on the child and responsibility. Even if no child support is paid, it is a different issue than visitation or being around for the kids and treated separately. Some states have a statute of limitations and some are years gone by before its considered abandonment. So if its allowed for 10 years and the father or the mother wants to be in the child's life and its only been a 5 years, that parent still has the right to say no to an adoption of their kid by a step parent.

also - even if he did contest it, if he is not sending child support, you can claim abandonment easily.

have an attorney complete the paperwork. it's not THAT expensive - especially if it is uncontested.

the biological parent will be notified of the adoption and handed the paperwork to give his consent.

Actually, Serene, I have heard that there are some states that still make the parent pay support after signing the rights away. Not sure if that keeps up in an adoption case of a step parent wanting to be considered the parent of a child or not but otherwise it is heard of.

Is your ex paying Child support? If so, he wont have to pay anymore. You have to go through the courts to get this established.

That's because you need to get a family attorney to draw up the documents, get them authorized and file them. This can ONLY be done through family court.
