my son has an iep and has been hospitalized 3 times now for mental health reasons the last time out of the hospital i asked for a behavor plan to be put in place they deined my request and now have kicked him off the bus and gave him alc. what rights do we have and who can I get to help?

An IEP does not excuse ill behavior or safety issues on the bus. If he is being a danger or disruptive to the bus driver or other kids then I am sorry but he shouldn't be on the bus and it is well within their rights to remove him from that privilege. As it is a privilege not a right.

All i know is that the school call and sayed he was off the bus til friday it was the princable that I talked to and I still have not recived any info about this yet he said they would send me a letter and that was monday but have still not recived it. We have had all kinds of problems with the bus driver in fact when he first called it in he called in on my other son because I have a total of five children who rid the bus so that is concerning to me to that he didn't even call it in right and my other son got called into the office and was talked to bout it even though he was not involed in it .So I am not for sure what is going on with this. They are not being very forthcoming with the info.We are also working with mpact at this point.

They can not deny your request then kick him off the bus. You need to find an advocate. Some will work probono for cases such as this. Why was he kicked off the bus? I'm a special Ed teacher who used to work at an ED center and I'm familiar with the system.



Is it the district who kicked him off, the driver, school???? I need more info please.

Thank you for the help and my concern is that this happened on friday on the way home and I was not called until monday at 2:16 and he was even able to ride the bus to school and home that day. The princable was supposed to give me a letter and vidoe explaining why he was kicked off but I have not recived either and I also found out that it was something that he supposedly said but they said that there is no sound on the bus so I am not for sure how they know what was said? thank you Kendall for the info it is a big help I now have mpact involved also and i know to ask for an indpendent person to come in and test him to .

Without more information, it's really hard to give you an answer. Schools can not remove a child from a bus without cause. There has to be documentation explaining why this occurred. It is not a right to ride the bus in the same manner as it is to go to school.

I don't know fully the situtation the resulted in your son's removal from riding the school bus. But as far as your rights when it come to your son special eduction you own the school in so many words. I would strongly suggest that the local A.E.A within your area. And ask to sit down with a special education advocate to full explain your rights as a parent. And next time you are schedule to attend a meet to discuss your son I.E.P. ask to have the A.E.A for a representive or child advocate attend the meet with you. If possible as for an advocate that is not affilated with the school district your son is attend. This would help to remove any bias the adovate may have for the district. My father was a special eduation teacher for many years.I also had an I.E.P during the time I was in school. Most parent don't understand that when your child is in the special education part of the school You as the parent have all the power. And NOT the school district.

My question for you is does your son have an iep and is main stream riding on a regular bus or has an iep and is apart of special needs.

As a special needs school bus driver I can tell you that your son should not have been kicked off the bus if he was not miss behaving. You should not need a behavior plan for your son to be on the bus, even with special needs its the same as main stream students if they miss behave they are removed from the bus if the bus(for that ride) is still at the school. If a child miss behaves during the ride the child should be brought back to the school(depending on how close you are to that stop) and the parents are called to pick up. All people meaning parents, teachers, whoever else is to be notified about it. Normally they will hold a meeting with everyone to go over what happened.

he was not disrupting the bus or the bus driver. I think that you should know all the info before passing judgment on my son.
