My son was attacked from behind in the bathroom at school

On the second day of school my son Ryan who is 11 years old in the 6th grade was attacked in the bathroom at school during lunch hour. The individual choked him from behind and asked him where is it. When Ryan ask him where's what the individual started to grab his right ankle, somehow Ryan did kick him, then the individual start twisting my son's right ankle slowly. Took Ryan to the doctor the following day, doctor said there was so bruising and trauma on the right ankle I met with the assistant principle and the head counselor on the 4th day I have asked them to checked the surveillance camera which they did. The assistant principle and head counselor stated they did not see anything and looked at Ryan and I like we were lying to them. They told me they will further investigate the incident. I have also spoke to a Police officer to file a complaint. The police officer said there was not enough evidence to file a claim. How long should I wait to talk to the school again? I truly belief this was not a bullying issue it is more of an assault. My son does not know anyone at the new school he was attending. He has been having nightmares since the attack.
