do i have the right as a mother to change the last name of my daughters father last name to my last name? even though my daughters dad is on the birth certificate? because he's not a father at all and she's more of my family than his .

If you live in the US, ANY request for a name change must be handled through the court system. You, as the mother, do not have the right to change anything.

@ Rebecca: They contributed 1/2 of your child's DNA. Enough said. They DO HAVE RIGHTS.

To change the child's last name you need to have the father's permission.

Fathers, even absent ones, still have rights where their kids are concerned.

I'm glad you brought this up because my ex doesn't even pay attention to my son. I heard tbe dad's have rights, b.s. right? If their not their physically, mentally, or emotionally than why should our children have to keep their names??
