Short Story: Small dog was attacked and killed in cul-de-sac by another dog. It was believed the "offending" dog was cited 3 times previous to the attack but it turns out it was the brother of the dog who actually committed the mauling. In other words, the dog who bit was not the one escaping. Children play in the area and one kid narrowly escaped on bike from the brother dog (not the biting dog). We have a 3 and 5 year old and it is uncomfortable playing out front with them after what occurred. The HOA is demanding the dog who bit be removed from the community. The neighbors/owners of dogs are pleading with us to prevent this from happening. We are reaching out to you for help in separating emotion from logic. Should the dog who bit be removed from premises? Should the dog who was cited 3 times by animal control (also the one who chased a child) be removed from the premises? Thank you for your input.

I think the dog who killed another dog needs to go. The 3 times cited dog should just be treated according to the rules. So it would stay, just as it would have if the first dog hadn't killed another dog.

Honestly I wouldn't prevent either of them being removed. If the owners didn't want to have them removed than they should of taken greater care in the preventions of the attacks. It sounds like they are irresponsible dog owners since they now have two dogs that they can not keep confined to their property. Ask yourself this how will you feel if it's your kid who is attacked by one of these dogs because you defended them?
