need to have an adoption file opened and take my ex to court

He kept him from me and when enough time passed, she adopted him. We were reunited last April I'm Florida. I told his dad that I wanted to go to court, he cut off our communication again. I haven't spoke to my son since December now. We were apart for 10 yes. I am so desperate. They told him that I gave him up. It never happened. Need help.

Do you have evidence that you have tried and tried? That's what Jodi is saying. In the eyes of the court, if you don't have evidence they will see it as abandonment. You need hard evidence.
You may have a case about her adopting your child though as you needed to give permission. Get yourself a lawyer because you will get a lot of differing advice here and some may not be right for where you live.

Unfortunately, if the adoption has gone ahead, and you have not attempted to do something about your rights in all this time, it is going to be difficult, or even impossible, to do anything about it. You need to talk to a lawyer. If there is no evidence that you made every effort to visit and fight for your rights, they could claim abandonment. That may not be the way it is in your heart, but the law doesn't look at how you feel, only how you act.

So, if you had shared custody, why did you not file contempt when he refused you visitation? That's my point. Why have you waited so long?

When we divorced he had residential custody granted. He has the money. We had shared custody tho. He isn't a good person. I kept out of the court system. I thought I could reach him but I when I tried I got nothing. Everyone I spoke to said that he would come around...I drank over this and just about died. He didn't care. I got past that and tried to contact but still, I was either blown off or told that I could not see him.

I'm confused. You are the mother and your ex kept your child from you? Why were you not able to file for any custody back when this first happened?
