Go to your state department of vital records. They will be able to tell you what the process is.

Most likely, it will involve petitioning the court, and allowing up to 6 weeks for people to respond. If the biological father responds negatively, the judge can decide to not allow the name change.

There is no way to do this in the US without going through the courts.

You live in the US, so you HAVE to go through the court process, Yesenia, regardless of whether or not the kid's father is on the BC or not.

For example, my son's name on his BC was incorrect. We, his biological parents, who are still married, still had to petition the courts, give a response time, wait for responses to be sent to the court, and pray that the judge would grant our request. It is our kid, our name, and all we were doing is changing the suffix from III to II (the third to the second). If even one person had responded negatively, we would have had to have a court date to argue our side.

So, since you live in the US, you will need to do a name change the legal way, by starting with your state department of vital records and following their process.

If you change your babies name, you cannot change the birth certificate. It is a legal document that cannot be altered. You don't want someone who is not a bio parent on the BC. That can create a whir wind shit storm.

We cannot tell you who appears on the BC. Who did you put on it?

Thank you. But I was wondering what if I am the only one that appears in the birth certificate?

i don't think you can do that. you'd have to be married or he'd have to adopt him. unless he's eighteen he can't change his name by deed poll like an adult can. they have to have their mothers surname or fathers surname. or if the mothers name changes it changes. they can't just randomly give children any name they want. sorry I'm pretty sure but check the san bernadino births deaths marriages office website for details on naming in your state.
