Night Crying

My stepson is waking up crying several times a night and is getting worse. He is with us three days a week and we have a newborn. It started before she born. His mother does not get along with my husband or I at all.
Lately he has been having bruise and deep scratches on him, my husband's ex claims that he is hurting himself. I don't see a two year old able to give himself bruises and cuts in those places. there are bruises of fingerprints on his thighs and lately we have bad scratches on his but, start inside the crack and going out.
He also has turned very quiet and will cry over having his diaper changed.
My husband and I don't know what to think of everything and we are going back to court over this among other things his ex has done and tried to do. His crying at night has gotten so bad that it wakes up the baby.
What do I do? We need help.

Definitely document everything. Is he in a crib or a regular bed? If he's in a regular bed maybe his father can sleep w/ him, so he's not as close to the baby while he has HFM.

we have taking pictures and my husband is filing next week. sounds good except we just found out he has hand foot mouth.

Maybe have him sleep with you guys? And definitely go back to court. All the advice Jodi gave you is sound and exactly everything else I would say to do.

You need to make sure you get photographs of these bruises as evidence in case you need it, and you could also take him to see a doctor to discuss your concerns - a doctor may be able to determine what could have caused these bruises. Keep in mind that if a doctor suspects abuse, he will have to report it to child protection, but that isn't necessarily a bad thing - it can assist with getting to the root of the problem.
