Parental right's taken away!

My son is now four years old, and his biological father has literally only seen him 3 months out of his four years of life, doesn't pay to help financially or even call or ask about him on a regular basis.. I went to court and gained full custody, but this last March he made it very clear that he didn't want to be responsible for my son anymore, that he was perfectly fine with my fiancé adopting him.

I am just curious if anyone has ever been in this situation. I'd like to know basically, if I could just go to a lawyer show the messages he sent me about giving up rights and it be the end of it, or if I'd be taken through a lengthy and expensive process.

I hope this makes sense. It's very hard to explain. I'd really like some help from those who have experience with this, or anything that could possibly help me out.

You definitely need to talk to a lawyer familiar w/ the particular laws in your area. I would 'guess' that w/ the bio father willing to sign away his rights and the fiance willing to adopt it shouldn't be too difficult to sort out... but only a lawyer in your area will be able to give you the best advice for this specific situation.

Chelsey, you need to consult an attorney. Good luck with everything!

First and foremost, congrats on your engagement! I understand the difficulty of your situation and actually agree with possibly seeking out consultation and professional guidance from a lawyer. Your son’s welfare appears to be your primary focus and being able to avoid him being hurt any further so again, good job to you for seeking out assistance.
