Ex is representative payee for our disabled child's SSI - child is 23, basically nonverbal and lives in a group home, not with me or ex. Our child is at my home several times a week for dinner, going out to the community (movies, dinner, shopping) and does overnights every weekend with me. I also take our child on trips out of state to visit family. Ex receives all the SSI and does not provide any for our child to use when with me. Ex visits child maybe once a week for a few hours, does not travel with child, does not have child stay over night with Ex. I do not see how Ex is spending any of the SSI funds for our child and ex will not give any of the funds to be used on our child when child is with me. Ex mentioned they are doing some "remodeling" to Ex's house for child but child is hardly there and child resides in group home.. Is it possible to get representative payee changed in this circumstance? I am really frustrated. I fully understand that the SS funds are for the child, not for the parents, but I do not see them being utilized for the child. I recieve no documentation to verify what funds are being used for. Just want to know if this is something I need to pursue and advocate for my child for or is it lost cause due to Ex already being representative payee..Thnx for any assistance.
