My son is 17 months old now, and his father has been in and out of his life. The only reason he has been in his life was because I went looking for him, went to court to get a paternity test, then we made an agreement, then that didnt work, so I started to invite him to do things with us so my son can see him. Now his disappering again, he doesnt give me any money for the baby, he bought him a couple of outfits when he was 10 months old. Anyway all he tells me now if I can see my son when ever I want and I will give you money whenever I want. Im really tired of him telling me that, so I want to get Full legal custody of the baby and allow him visitation rights. I dont want his money because Ive been doing fine with the baby by myself, he can go live his life and when he has his days he can spend time with him. Do you think the judge will allow me to get custody and not recieve any money? Also I think he still smokes marijuana, if thats so I dont think he should have any rights until he gets himself together, what do you think?

Thank you very much for your response, I could ask them for him to take a drug test. If he refuses then they would automatically know his hiding something.

In most cases, the judge is still going to force him to pay child support. It's up to you afterward if you want to pursue it.

As for him smoking pot, you only THINK he is smoking it. You don't know for sure and you have no proof. You have to have proof in order for a judge to completely take his rights away and even then it is extremely hard to do.
