Should I take my daughters fathers rights from him, if he has next to no contact with her?

My daughters father has hardly any contact with her, unless you count the once a moth text messages, which is usually only a quick " Hi, how are you doing and bye" I have asked him a number of times just to sign off of her so she can just stop worrying about if he is going to talk to her this month and he refuses everytime. It has gotten to the point that she no longer wants to see him. She will stay the night at her big brothers house, but not his. BTW her brother lives right behind her fathers house. What other options to I have? She does have a Father figure in her life, my new husband has stepped up to be the kind of Dad that she needs. It makes us very angry to know that my X has a wonderful little girl waiting for him to be there for her and yet he seems to not care or realize any of this.

You cannot arbitrarily "take his rights". He can either give up parental rights, or he can have them taken by the courts, but you aren't in that position.

Let her step dad be her father figure. Let them have a great relationship. Teach her how to handle her dad's distance, but make sure that you are not contributing to that distance. If she's old enough, she can make the choice whether or not to see him, but if contact is in a court order, then it needs to be addressed through the courts.

Thanks for the info Shawnn, I do give her the choice to see her father or not. On the off chance that he does call and want to see her, she is the deciding factor. The saddest part is, she worries about him getting mad at her. I have an appointment with my lawyers that done my custody orders and we are talking about my other options. I never wanted it to happen this way, but to see te hurt in this little girls eyes breaks my heart. Thanks again for the info.
