I really wanted to ask these two questions because He wants to stop paying child support because the bank is putting a lean on his car, can he actually do that? And if so do I have the right to ask him to sign his rights away because he wants to stop paying child support even if his name is on the birth certificate?

Legally he can not just choose to stop supporting his child... likely the reason the bank is putting a lien on his car.

The child has a right to be equally supported (financially and emotionally) by both parents. Many courts recognize this fact and will not allow a parent to sign away their rights unless the other parent has a spouse willing to adopt the child.

Different states have different laws about all of this and different judges will make different rulings w/in those laws... so your questions should really be directed to a lawyer in your particular area.

He doesn't get the option to stop child support. And signing his rights away often isn't only the way to go either, and doesn't necessarily get him out of child support - it depends on where you live. Does he see his child?
