They're called 'friends'...or enablers, whichever term you prefer.
When he shows up stoned, make him take a drug test (simple tests for cannibis can be found at your drugstore for around $15), and when it comes up positive, impose restrictions. Remove privileges such as cell phone, outings, anything but school, and make the school aware of his problems.
If that doesn't work, you can mandate rehab, or turn him over to the youth center if he refuses.

If you would turn him in when he is stoned, eventually a judge will mandate rehab, and he won't have a choice. So, you give him a choice. Either he voluntarily enters rehab, or you turn him in each time he's loaded. He's 16. Even if you live in a state where marijuana consumption is legal, he's still underage, and therefore consuming illegally, which will end him up in jail.
Counseling and rehab are two very different arenas, as well.

Thanks I will look into that, even if he 16 can he refuse? I've spent so much money with conseling and believe it seem to waste of money because their still issues and if he does want to change its hard for a counselor or myself to make it happen it has to be within him. And that the big problem
