Sons father wont bring him home

My sons father about a week a week and a half ago came and took my son he keeps saying he'll bring him back but so far he hasn't. I tried going to the police department and getting him for kidnapping but they say its a civil issue and it has to be taken to court. he goes to work and I'm not sure who is keeping Carson with my son.i don't know what to do i don't have a job so i'm afraid if we do go to court they'll let his father have him if anyone has any help to offer id greatly appreciate it.

So you don't have court orders. Unfortunately, this is not a kidnapping. The father has the same right you do. The police are right. This has nothing to do with them because the father is doing nothing illegal. The only way you are going to get your child back, by the sounds of it, is going to court. And yes, you do run the risk that the court may award custody to his father, but it is highly unlikely that he would get full custody if you fought for it. It's probably more likely you will get joint custody. And if he doesn't allow you visitation while you wait for it to be heard in court, you could claim parental alienation, and he'd be less likely to get custody.

It's a confusing process, and no-one can say for sure how it will go. But right now, it is your only option.

This is why EVERYONE should have court orders in place for custody of their children when they separate - because when things go wrong, it is never in the best interests of the poor child.
