I am involved in a sticky custody battle. I have full custody of my daughter but the father has visitation rights... My child fell and hit her eye the other day and is now sporting a black eye... Her father is trying to take me to court and say that she gets hurt to much... My daughter is beyond clumsy and does get scrapes and what not often but that does not mean that she is being abused... accidents happen... Can he take my child from me over bruises on her knees or black eyes...? also she tried to be superman 8 months back and hurt her arm...She has had full body scans and everything has checked out good... what do i do?

She jumped off of the bed in august and cracked her arm... and she has had a few scrapes on her knees from falling off of the bed... also in october one of the kids at the sitter bit her on the arm... thats is the only thing that has happened to her... other than the most recent where he fell and hit her eye on the toilet... he called DCFS about the bite on her arm and that was unfounded... I have taken her to the doctor for all of the except the scrapes on her knee... It is more less something just to get at me... There is a current order of protection on him from me for abuse... he had to pay a high priced attorney and now he is upset... but other than that she is a healthy, smart, very active child... Just very clumpsy...But thank you very much for the advise...

If he is being difficult about it... I think I would take her to the doctor every time she gets a scratch, so there is a 'paper trail' of when and how she got hurt. Accidents do happen, but he might stand a chance if the judge feels the accidents are happening TOO much. Judges do know that kids will be kids and accidents/injuries do occur, but too many and they might start thinking neglect... which is why I suggest a paper trail from the doctor.... especially if the doctor knows her well and knows about the clumsiness issue.

Good luck!
