supervised visitation

Not sure if I will get any responses, but here goes. There is a court order in place that my child's father have supervised visitation. The person who was the 3rd party supervisor is no longer able to oversee the visits. Another party stepped up and offered, then when I gave them the paperwork to transfer the responsibility to them. They no longer think they want to do so. I don't think they realized the time commitment and responsibilities. Anyway this person waited until the night before my child is supposed to be going to his father's house for a overnight visit to tell me this. When I ask if they would do so for at least this visit/ weekend I get no response. So I guess ultimately what my question is....if I know that there will be no one there to supervise the visit. (They are supervised for a reason). Do I still have to send my child over for the visit then file paperwork on Monday as to them not following the order and just hope and pray that it goes ok for one weekend? Or can I withhold the visit until there is a supervisor in place? Any real advice would be welcomed. Thanks for your time.

Hi 😊 honestly if the danger is real and you are afraid of the visit being unsupervised do not go with it. They are, after all, supervised for a reason. Just like the other person can call the cops on you for refusing to allow visitation in designated days you can refuse visits that are supposed to be supervised if they aren't. You can always call your local police department in the morning to ask them about this issue since they are most likely the most informed in these matters.

My father and mother got separated when I was 5 I was physically abused by my mother and this resulted in a huge legal war between the two. So, I just asked my dad and he told me you have the right to refuse. hope I helped a bit. 😊 good luck, seriously though, your local police station can be a great help with legal questions. Just call them up whenever you have a question like this and they will most likely let you know
