Taking her in a different state

My ex husband lives in North Carolina, and I'm in NY. He wants to take our daughter to his house soon and I'm totally against it. We have no written documents about custody. What can i do to stop that?

If it is joint custody then there should be something outlined in the visitation for this. If he has the visitation and you are the primary parent in this joint venture he still has to bring her home be the end of the visitation. READ your custody agreement.

If you have joint custody then there should be something written and notarized by the court. If you don't have anything legal drawn up.... you need it. It is 'typically' pretty hard to get full custody without a really good, legitimate reason, but with the two of you living in different states.... there should be some sort of written visitation schedule.

File for custody. She will, most likely, not be allowed to leave the state until the custody/visitation is finalized... and then when he has his visitations to take her... you will have the court order backing you up so that he has to return her when the visitation time is over.
