Ok, in December of 2015 Jessica met her father, who on his own terms, for the first time in her life for the first time. She was 5 now 6. He tells me he has all these rights bc he is the father. Nonsense. I haven't gone to him for child support yet however, it's almost been a year. It's not fair to my parents that they are the ones that help us out. What should I do, how, and how will it affect my child and me. She is on Access to medical Insurance and I'm on Disability. I've been disabled for 18 year due to a TBI from a car accident. I just don't want the chil support money to effect that. That is why it's taking me so long. He also owe the IRS with taxes that he's paying off.

It's not nonsense that he has all these rights. He actually does have rights, whether he pays child support or not. But I can't answer whether child support will affect your disability support. But just let me say, you can't have it both ways. You say he shouldn't have rights because he isn't paying child support, BUT you are not wanting to claim child support in case it impacts on your disability.

There should have been a custody, visitation, and child support court order put in place when she was a baby. Your daughter has a right to a relationship w/ her father regardless of anything else that has happened in the past. Child support 'shouldn't' impact your disability money (but don't take my word for it... talk to a lawyer), but may or may not impact her medical insurance. I know my court order says that the father is supposed to provide medical insurance, but since he doesn't have a job on the books and doesn't pay his child support... my kids are covered by state insurance.
