trying to get custody

I am looking for anyone who has gone through a similar situation.
my 24 year old daughter has a 5 month old baby I was given kinship by CAS. CAS is encouraging me to take custody. Father of baby lives in a different province and has been back to visit baby 3 times. My daughter is willing to give me custody but the father is not. I have had both of them served, court date is in September. I am afraid the court will give custody to the father. Father also has drug and alcohol issues that I have no way of proving. any comments or opinions etc will help thank you.

You can petition for drug and alcohol testing to be done at the hearing. Ultimately, if he shows up and wants his child and he show to be capable of parenting, he will likely get custody. If he hasn't wanted the baby thus far, perhaps he won't even show up and your request will be granted. Why were you given custody in the first place? This post sounds like you are not in the US, so I am not positive how your family court works, but the safety of the child must be priority.

I am in Ontario Canada, was given kinship due to my daughters alcoholism.
thanks for your responce. I go and see my lawyer August 11th If there is a big chance the father will get custody I won't go through with it. My daughter(mom of baby) is currently living with me and trying to stay sober.
