My fiance and I have filed for temporary full custody due to his son constantly coming back from his mother's with marks and now constant threats going on out at her apartment with my fiance's son is there. My fiance my granted custody until a later court hearing, which is now the end of this month. The mother is telling everyone CPS took her child off her because we lied about burn marks, and CPS called my fiance to pick him up. We have been documenting for months and recording calls. Most photos have been seen when we went for temp custody, I'm wondering if the court would have shown the photos to the mother already or if she will not be aware until we go to court for the final hearing? We are in the state of Ohio. Any advice dealing with custody would be helpful.

Then all that is being done is all you can do. It will be up to the judge and the lawyers to get things going and decided in the final hearing.

Yes, CPS was contacted and notified every time. Police reports and medical records have been collected by us also for final hearing. Also I realize the sought custody is his, not mine. I was merely looking for any advice since I've never dealt with any of this before.

Did you take this to CPS in the first place the first time the child came back from the mother's with all those marks and things on him? That would have been one of the first things you should have done. If you have that documentation then it should prove to the judge what you have noted going on. But I must also warn you since you are the man's fiance that the custody that is being sought is his not yours. Be his support though for he will need it but don't say anything unless you are to be an actual witness.

She has a lawyer and our lawyer and along with the judge when we went for temporary custody have seen the photos. We have a final hearing the end of this month.

If the mother has a lawyer, the lawyer may have seen ( discovery) and discussed with the mother. If the mother is representing herselt and has not seen the photos they may be not admissable.
