Oh, well THAT is different. I think you needs some legal advice. You didn't mention how old they were, but I would suggest getting a court appointed child psychologist to talk to the children, because if there is abuse going on, he should NOT have access to them, or at the very least, it should be supervised. As their mother, it is your responsibility to protect them from this, so you need to take action now. I don't know what country you are in, but I am sure there are resources that can assist you in your endeavours.

they don't wanna see him because he used to hit them and that is partly why i left... they don't feel comfortable alone with him

I'm in Canada, and here legally, it's 14... I'm pretty sure that's in every province, but might vary by a year or two.

Legally? Differes state to state, country to country .... most gets get a legal voice at age .. 14, I think.

Beyond that .... why are they saying they don't want to see him? He frightens them? Some kids tell Mom, "I don't want to see Dad", then tell Dad, "I don't want to see Mom"

This is how they know to be loyal to both, and keep the peace. It is an ugly place for a kid to be and in this situation, the choice should not be in their hands. It should not be 'their fault' if they see Mom or Dad.
