Sorry to assume it was a girl! Do you think he has trouble with the work? if he has a hard time he may be frustrated and afraid to fail. Or, if it's too easy and he is bored?
Talk to the teacher and set up a list of expectations; you must stay in your seat, you must be quiet when asked, you must do your work when asked, no touching or disturbing the other kids. Maybe start with five goals and work up from there. Tell him you and the teacher have the same set of rules and check in with the teacher at the end of the day. If you can't speak to her directly, she can email you. I don't like it when teachers send notes home (especially if your child can read) they tend to "vanish". Maybe make a chart of the goals/rules and for each one he achieves he earns a small (like a few m&ms) reward, If he follows them all then he gets the bonus TV time or whatever you think he wants the most. Instead of punishing the bad behavior, try to reward the positive behavior. Good luck!

I guess positive reinforcement is a good place to start. If she has a good day, she gets extra bedtime stories, TV, computer or outside play. Whatever she likes the most.
I am curious how is she misbehaving? Have you talked to her teacher? Do you have other kids? Is this new for her?
