what do i do when my sons father is trying to get custody over him? an also can he if he has diabetes an can barely take care of himself?

my son is currently with a family member an the father is trying to get custody but he can barely take care of his diabetes what should i do??

If the system placed him because they said he was neglected you had better work quick to stabilize and do everything they ask of you. If you are not willing to show up for every visit, appointment, parenting class, he will have grounds to make the judge choose between the two places, with his father or with your family.

Geez it all sounds really bad for the baby. If they say you neglected him and you don't think you have there is a real problem there. Hope you seek help and get stable and get your child. But if you can't stabilize your life the father should have the parental right to raise the child rather than your family.

no hes with my family becuz i dont have a stable place right now an they said that he was niglected but i have never once neglected him

those are really tough questions.

I know that the father must be named on the birth certificate to even file for the court to hear his case. If he isn't he first has to pay to establish paternity.

If the child is with a family member due to your inability to care for him due to addiction, physical, or mental illness, then he could have grounds to request a review of current custody.

I am not sure if the family member that the child is with would vouch for the father as well as testify to offering assistance to the father if he were to gain custody. Though the dad has a condition the support system around him such as parents and other family members willing to be involved with care makes a great deal of a difference to a judge.
