What rights does a father have in NJ.

My daughter is 6 her father took off when i was pregnant no paternity test and he is not on her birth certificate. A month ago he showed up at her school and tried to take her the school checked her records and hes not on the birth cert. so they called the police and myself they basicly said i could do a restraing order but he would probally find out my address threw paper work plus i have no address for him. Now he tried it again today i have no lawyer money what can i do and what rights does he have. We live in Ewing, NJ. Thank you.

The only persons who can pick up your child from school are those that you personally authorize. That's what you spend all of that time filling out forms at the beginning of each year for. Contact your child's school, and confirm that your list of allowable people is on file. By law, they are not supposed to release a child to anyone not on your approved list without prior authorization from you.

As long as the school is aware of the situation... nope.

When I got divorced I brought in my divorce decree to the school office to show them what the visitation schedule was stating, so that they were aware that my ex was not allowed to pick them up from school. He did show up to see them a few times (which I was ok with.. as long as they didn't go anywhere), but the school called to make me aware each time.

Right now.... none. He can go to court and request a paternity test though. At that point, if the two of you aren't able to work together it would be a judge's determination on what rights he would have. Could be none, could be supervised visitations, could be unsupervised visitations, could be joint custody. There's no way anyone on here could predict what a judge will or will not rule in your case.

Like I said though.... until he has proof that he is her father he has no rights.

Make sure the school knows (sounds like they already do, but maybe have a little meeting anyway) the exact situation and that the school is to call you anytime anyone comes to get your daughter for any reason... even if you've ok'ed it ahead of time.

'I' wouldn't press charges. Not sure what charges you could press anyway. The school can always call the police if he becomes a problem for them.

Thank you, the principal explained that to me he was trying to say his "lawyer" said he can pick her up whenever he wants. He can't because he's not on the birth certificate. I was wondering if I can press charges this is the second time he tried to get her without me knowing anything plus he lied to the school saying my wife told me to pick our child up if they wouldn't of been on the ball he would of took her and I wouldn't of been able to contact him and he doesn't have our info. I never would of seen her again.

Thank you he is under he impression he can still pick her up from school with no paternity test. I just wanted to make sure he can't. Thank you.
