what to do bout smoking at a daycare

what to do? I just found out that my 2yr old daughter has bronkus. she has been sick alot since she started daycare couldnt figure out why other then the germs of other kids. Bt then this morning after the call from the dr i talked to my mother and she says that someone came in her store and told her that the people at th daycare was smoking in th building. and then when i dropped my daughter off this morning they were outside leting the kids play one lady was holding a baby that wasnt even old enough to walk and th other lady was sittin next to her smoking with a girl bout my daughters age at her feet. what do i do about this? my daughter loves day care an being around other kids i have no other options untill school gets out and that would only tempory till school starts back. but her heath comes first and i will do whatever it takes to make sure she stays healthy.

regardless, Alisha, they should not be smoking on the playground. They need to keep it to their breaks. The example that they are showing the kids is not ok!

it is illegal in this area because you cant smoking the a vehicle with a child under the age of 13yrs old in the state of louisiana. I talking to the ladys at the daycare this morning and they said that no one has been smoking in side the building since thy opened only when thy was under constuction before they opened. an that they smoke outside while the kids play but smetime the kids run up to them while thy are smoking. i told i white lie which was that the dr said my daughter was having an allergic reacting to cirgatte smoke and i didnt understand my because NO one in our house smokes. and he month dropped with giult and she said that she was very sorry and who only take smoke breaks when my daughter was napping because she is very atached to this one woman she even calls her nana. so i will see in the next two weeks if anything changes. wish me luck and thanks for the advice!

Bronchitis? is that what your daughter has? I would turn the daycare in and find another one. That cannot possibly be legal.

If you are generally happy with the daycare, then you should try to work this out with them and avoid reporting them.

Talk to the management, and explain that, due to your daughter's health concerns, you will be reporting the facility in "X" number of days. That gives them time to come into compliance with any existing regulations.

However, if there is not an existing regulation regarding smoking indoors in a public (work) place, or nothing stating that smoking in a daycare is illegal, you won't get far. Make sure what the laws are in your area first. If they ARE breaking the law, then by all means report them. But, if there aren't laws in place, then you'll have to settle for dealing with the management, and hoping for the best.

I hope that there are laws in place. But, regardless of that, they should not be smoking during their working hours, unless they are on break, at which time they should remove themselves from the immediate area.

I would report the facility, as well. Second hand smoke is dangerous.

Have you talked to the staff at the daycare about smoking around the children? If not I'd start with that. Then if they are not willing to stop smoking around the children, I'd find a different daycare. Good luck!
