My sons bike got run over

My son was riding his bike in the parking lot (supervised of course) and he got hurt, while he was being comforted the bike was left in the parking lot for about 5 minutes. As someone was backing out in her SUV she ran over the bike and it is now ruined. The lady driving her SUV also got a flat tire. I gave my phone number to the ladys friend who actually lives in the apt complex (the lady in the SUV was simply visiting) and she is supposed to call me. I am thinking to ask for a replacment bike,a used one is ok. What would you do?

But she was in a parking lot. Children shouldn't be playing there, supervised or not as they are purely areas for cars. If it was me I wouldn't ask for a replacement bike. A neighbour of mine reversed over another neighbours child's bike as it had been left behind her car on her own driveway. The bikes owners had to pay for damage to the underneath of the car (it ripped off the exhaust) so I would tread very carefully there, as others have pointed out she has every right to ask you to pay for her damage.

Be glad your son wasn't on the bike. If you talk to the lady though, please impress upon her how serious it could have been. She really should have been paying attention, especially if she was in a place where children are playing!

since it was an accident and she recieved damage to her vehicle i would leave it alone or you might be asked to buy a tire.

Are you being expected to replace the tire?



If the SUV lady is not requested a new tire, i wouldn't request a new bike. I would call it sqaure, walk away and replace the bike myself. There really is no need for the drama is there?

well i hate to say it, but good luck. not to be rude, but if she blew a tire thats gonna run her 250-300 bucks, and shes gonna say the bike should not have been there. NOW in your defence, what if your CHILD had been that bike... she obviusoly was not paying attention AT ALL, so you have that on your side. I'd ask for a replacement... but dont hold your breath. HOWEVER: lay down that guilt trip, next time it might not be a bike she hits...
