I lived in Wisconsin. Ok this goes along with my first thread about getting custody of my husbands daughter.

ANWAYS! we just got papers in the mail for paying child support it says that his ex lives in her old apartment right? SHE GOT KICKED OUT A WHILE AGO BECAUSE SHE DIDN'T TAKE CARE OF IT OR CLEAN IT. She signed the papers knowing this. Also she's getting Wic help when she's living with her mom who makes enough money to where she shouldn't be getting Wic help.

I hope this all makes sense I'm so angry right now I don't even know lol

You can address part of this at court. That would be the child support portion. For the rest, file a fraud report with social services and public health. Easily done, easily proven in this case, and yes, she can and should get in trouble for it. It depends on what is found, but if proven she can be required to pay back the amount received (cash value) and prevented from using state services for any reason in the future.

I do have to agree with the living situation and her lying about it. We have the same problem with my husbands ex and their son. We've delt with this stuff for 10 years now and we don't mind that she and him get state help with food assistance or if he were young enough to get Wic that wouldn't bother us either. The way I look at it is it's really for the child and of course for her to an extent. Plus, at least she can only get milk, fruit, veggies, eggs, juice, and ect. not get cash to go by some crack like my hubbys ex is know to do. Things could be worse. Your husband does have a right to request where she is living from the child support office if they still end up getting the wrong address he can let them know and she'll be investigated.

You can call your lawyer. Even if you can't get a court date yet they can investigate. It will make it easier to get everything taken care of when you do get a court date if they already know everything. If you want until July to tell them about this it will take even longer.

They should change the child support to reflect that you have been over paying.

i have to say this though: it gets me very upset when i see people abusing the system & if thats the case with you daughters mom then you & your husband need to bring that to the counties attention..

i live in wisconsin as well...the problem with wic though is even if she is living with her mother (who does make enough), her mother has the right to tell wic (if the were to question) that she rents & doesn't assume responsibility for her daughter & granddaughter. my son & i live with my parents who make a decent living (i also work but don't make enough w/o child support) & i am eligable for all state assistance.

1. File a response with the court prior to your hearing. Be sure you're succinct, descriptive, thorough, and don't attack her character. As the child belongs to your husband, the response can not be filed by you, unless he is physically or mentally unable to do it himself.
2. You can probably report her anonymously to WIC, as it's her responsibility to update them as to any changes in her residence or income. The judge isn't going to do anything about it, and it's not going to benefit you to bring it up in court.

Go to the court house and ask for paperwork to do a response back on what you recevied from her fill it out with all the new information you have on her and do what is called a declaration put everything you that has changed in her situation take back to the clerks and file it before you go to court so the judge is aware of what has happend since she sent you the paperwork. And that will help you out better so the judge can question her on all the facts you give.

We can't get a court date until July AT LEAST! My husband doesn't know about this yet though since he's working right now.

So why don't you bring these papers to the courts and tell them this? They will have to investigate, of course, but thats easily done.
