I have 2 daughters one is 9 yrs and a 1yr old i take care of my girls mon-friday night da father comes and takes them friday night till Sunday night he filed paper and whats to have primary custody of our kids because im a bad mom thats what he saying just because i whant to start a new life whith someone new will he win at court?? im scared i dont whant to lose my babies oh and he works out of town and stays in hotels

Do you have current court orders?

If not, then he CAN take them anytime and you need these court orders. It is unlikely that he will succeed at primary custody if he has no place for the children. But you need custody and visitation orders, regardless.

As I said, get a lawyer.

Ev witt.... he works in north cali stays in different hotels and works different areas hes still able to have the girls how is he able to keep my daughter in school and stay in different hotels i moved in whith my mother im a stay home mom for now theirs 5 rooms here my girls have everything and school is across the street i take care of them mon-fri night he drops them back to me on Sunday night he tells me he can take them from me anytime he threatens me by using my kids

I posted on another post of this same person....it makes no difference if dad works and travels during week or not if he gets weekends to be with the kids. He would have to prove you unfit and until he has that he can talk all he wants. Judges want only proof. He also has the right to petition for custody too.

I known him for 8 yrs we been together for 2 1/2 yrs i left him because of my baby daddy putting me through all this stress no we dont leave together i moved in with my mother so their would be no issues

It depends on the circumstances. How long have you known this new person? Have you moved this person into your house? Who is this new person? Are you planning on moving? There are so many factors that could be taken into account. You should make sure you have a lawyer.
