Can I change my sons last name to my married name?

If there is no father on my sons birth certificate can I change my sons last name to my married name? He has my maiden name right now.

If his name is on the BC in the state of ohio he has no rights to sign over. I would see if thats the same where you live. A single mother has sole custody of the child if she was not married in the State oh Ohio.

You need to have the biological dad sign his rights so that your husband can adopt. I am sure there are ways if you can't find him that the courts can terminate his parental rights. Sucks when men become "sperm donors". Good luck!

Oh yes! I do love him and he wants to adopt, I just dont know all the legal issues that go along with that! :) He has been my sons father since he was 5 months old and he will be 2 next month. Isaiah knows only my husband as his father. And his bio father said he wanted nothing to do with him (I have documented proof of this) but I can't find his bio father to get him to sign over his rights. I know I can post an add in the paper, so I think that is the route I will go. Thank you all for your support and your help!

You can just change his name or you might want to go one more step and let your husband adopt him. If you truely love the man you are marrying and he has a good relationship with your child then it might be something to think about.

I think it will be easier for you because you don't have a dad listed... but remember you still have to put an ad in the local newspaper stating that you are changing the name. My son had my last name until I married his dad 9 months later and his name change got delyed because we didn't post the ad. And in ca it is like 1000 dollars to change a name

Here in CO you can. If you are the sole parent listed on the birth certificate then you have full control. Hope it helps!
