State custody order is through (or your home state)?

Alberta, Canada

Children involved (age & gender) and your relationship to them (biological/ step/ grandparent/ guardian)?

9 year old girl, I am stepmom

Has custody been decided by a court?

Yes, it was decided when my SD was 6 monts old, but biomom pretends it's different than it is...

Is there an open case pending in court?

Not at this time, but we're usually in court every 3 years or so. I don't think there's anything she can get from us at this point.

Do you have an attorney?

We did.

Who is the custodial parent (or primary parent)?

My partner has sole custody.

A brief description of your custody issue?

The biomom keeps fighting with us, claiming she has joint custody, despite the very clear wording in the divorce agreement. Everytime she doesn't feel like paying child support anymore, she tries to take us to court and win custody. My SD has lived with her dad (my partner) for her entire life, seeing her mom every second weekend. Everytime, biomom has been awarded more time, she soon after gives it back up because she is too lazy to be a parent. She has had men in and out of her life, but is somewhat stablized at the moment. She still never puts her kids interest before her own. Frustrating!

A brief description of your custody issue? I'll try to be brief! Bio mom saw her son off and on for the first 6 months of his life (overall she had him for less than half of that time). at 6 months old(september 2008)...her family contacted my husband about abuse allegations and he went and got the baby from her. (by this time we had still never been to court...just between them). we got dfs involved and they told us to not give him back to her. she called a couple times to ask to see him...a couple to threaten us...but never really tried. she showed up in january (after receiving the child support order) and when the police had to get involved (long story...she is crazy!!!) they would not hand him over. she tried for an ex parte (spelling?) and the judge would not grant it. so now here we are over a year since she has contacted us in any way and we are going to court next week to get my husbands name on the birth certificate and get full custody of him.

California has jurisdiction due to that's where the Ex filed. I live in MD.

6 year old daughter. Bio.

I thought it had with 100% physical to me and split legal. But ex has begun pushing for more custody [he is NOT bio parent].

There is an open case still in court because he has not seen fit to file all the paperwork for the divorce that he filed in the first place ;) He's great like that.

Do you have an attorney? Yes. This is my 2nd attorney in fact.

Who is the custodial parent (or primary parent)? I am, have been, and will continue to be the only true parent in the situation. Ex is NOT bio parent.

A brief description of your custody issue? Ex is refiling for more custody. He has given no reason and is well behind on child support. He does not make use of court appointed contact time and hasn't called my daughter since February. He gave up Thanksgiving visitation and then called an emergency ex-parte hearing and the court gave him an extra week at Christmas. Now I find out he's pushing for me to pay travel costs and give up more custody. It's great.

A brief description of your custody issue? her dad and i never lived together for a long list of reasons. she's always lived with me and has seen him whenever he wanted. we were together until she was 4 mos old, but wasn't much help physically or financially. I worked visitation around his schedule until this month. I filed for support in may (my lawyer threw in a custody case pro bono). the ex suddenly decided, after a pattern of seeing her 8 days a month (4 nights, 4 day visits) that he suddenly wants shared custody...but since i filed he still barely sees her even though he has been offered plenty of time. because of delays (inability to serve him, then his refusal to file his papers on time) we won't get another court date until next month...this will be a long nasty battle. i have valid reasons for not allowing him to have shared custody, but i won't list them here.

A brief description of your custody issue?
My ex has two DUI's in the past yr, wants to have her over night even though he doesn't have a room for her. He also does not have a license. When he drinks he gets extremely verbally abusive and recently attacked his own mother to the point that she was in the fetal position on the floor in the corner. He wants over night visitation and I will not agree to that. I want full legal custody as he has a drinking problem and has not done anything to remedy that. He has not proven that he has made sound decisions in the past.

A brief description of your custody issue? I don't have a custody order. the father of my girls just decided not to be involved except pay child support. i gave him multiple chances to see them and he did nothing. he came a few times but that was it. they have seen him on and off and lately it has been 4 years since the last time they saw him. even if there was a custody issue, i swear the judge would look at him and tell him that he gets nothing but supervised visitations. that is my story in the short form. can't wait to meet other mother's out there who have dead beat fathers :)

State custody order is through (or your home state)? All of the legal stuff is in Indiana. We Live in Florida

Children involved (age & gender) and your relationship to them (biological/ step/ grandparent/ guardian)? I'm a step mother to Layton who's 4. I'm bio mom to 2 daughters 18 months and 6 yrs old.

Has custody been decided by a court? Custody for Layton resides with his mother in Indiana unfortunately

Is there an open case pending in court? Not until my husband comes home.

Do you have an attorney? Kind of, working on it

Who is the custodial parent (or primary parent)? His mother is

A brief description of your custody issue?

This issue is anyhting but brief... but I'll try. Layton lives with his sorry excuse for a mother in Indiana. We have always wanted custody but actually had to leave the state becaue she kept calling the police on my husband. She had him pulled over several times because she saw him to exchange their son and then reported his car as a stolen one. It got to the point where he couldn't even drive anywhere alone. So we moved to be near my family in Florida after my husband joined the Army. After 3 years of severe PAS and god know what else my husband is deployed. She eseriously messed up and left her son with her parents for almost 5 months because she was living with her boyfriend. Now that she has him back her parents have begged us to help, then recanted, so we took it from there. We've built quite a case, the biggest problem is that my husband is deployed until next Jan. I can't do anything as the step mom which kills me. I have all this evidence to get custody and now we have to wait. I'm so afraid that something is going to happen to him and there is no one to protect him. It's just so hard when everything else in another state.

Who is the custodial parent (or primary parent)? Their father

A brief description of your custody issue? My ex decided that it would be best for the children to stay with him, and in the same school district. I was awarded visitation on Saturdays, for approximately 8 hours. I used to be a stay at home mom, so it is very hard to get used to. It has been like this for three and a half years now, I did reopen the case last year and it is still open, trying to get an equal amount of time with my children.

Children involved (age & gender) and your relationship to them (biological/ step/ grandparent/ guardian)?

One biological son, 12, one step-son, 10 (I also have a 17 year old step daughter, but given she is almost an adult, custody issues are really irrelevant these days).

Has custody been decided by a court? Yes

Is there an open case pending in court? No

Do you have an attorney? Yes

Who is the custodial parent (or primary parent)? I am of my bio son, bio mother is with step son.

A brief description of your custody issue?

These days it is quiet on the front, but one never knows.

I have had many issues with my ex husband, and after several issues, I was finally granted full parental responsibility (as opposed to the preferred shared parental responsibility in this country) so that I could get my son into schools, etc without my ex interfering and telling the school he didn't want him at that school, just to be vindictive. The judge thought it was ridiculous, and decided that he shouldn't have the right to contribute to any further parental decisions.

With regard to my step son, it has all been decided for several years now, and arrangements are good, but her husband is in the Navy, so you never know when visitation will be affected by a move. We are hoping things stay the way they are for several years to come.

6 year-old daughter - I am her "bonus" mom (but we have her 90% of the time)

Has custody been decided by a court?

a little bit by the court, but mostly by my daughter (the court wanted to grant us even more custody, but my daughter wants to see her bio mom)

Is there an open case pending in court?

yes, but only for child support right now

Do you have an attorney?

nope, can't afford one right now

Who is the custodial parent (or primary parent)?

my husband is the custodial parent - my daughter's bio mom abandoned them when my daughter was 3

A brief description of your custody issue?

We have been in and out of the court system for 3 years now. My daughter's bio mom left and only wanted custody again when she found out my hubby and I were getting married. It's been a long hard road, and it isn't done yet, but it is all worth it for the well-being of my beautiful little girl! (yes, I call her "my daughter" bio moms, please do not give me a hard time about it. I am here with her full time and in my heart she is just like my 2 biological children) :D

A brief description of your custody issue? I just finished a 2 year custody battle (June 2009). The biological father has supervised visitation every other weekend. It is supervised by his mother. While he was never formally charged with the crime, he had been accused of molesting his much younger sister. The courts found that there was legitimate concern and evidence indicating that these allegations were true.
