Has anyone sold their digital scrapbooking kits?

I am considering trying to start a business creating and selling digital scrapbooking kits. Does anyone have any experience in this? Can I use patterns and images from a prgram like Photoshop as long as I change them in some way? Do certain programs have different restrictions? If I take a picture of a Christmas tree in someone's yard, a bird at the zoo, or a sign at Disney World do I need to get permission to use those in my designs? Where did you start if you did/do this?
