I agree with everyone except that no one has mentioned the fact it was stated that "alcohol was a factor for both the accused and the victim..." In my opinion if two adults decide to get so inebriated that they lose all ability to discern right from wrong and decide to fool around, and both of them are drunk, she wakes up feeling raped he wakes up feeling like he got laid. How can her being drunk not be a factor in this as well.
So if you get dressed up in skanky clothes, with make up on and feel sexy, you drink way way too much, you start making out with a dude who is equally plastered, you start going too far, you change you mind but he doesn't get the signal... do you get where I'm going with this?
She has a scar on her knee, were they maybe doing it doggy style? Is there more to this than we are hearing? How drunk were they?
He deserves jail if he indeed forced himself on her and knew he was doing so. But if he thought they were just having some drunk outdoor monkey sex, than that's different.

I'm so sick of men being excused for being animals. A man can control himself, I don't care how much teasing, suggesting or even vocal agreement a girl has given. If she starts to say no at any time no matter how far things have gotten then that guy had better stop. Other wise it is rape.

Date rape, acquaintance rape, even spousal rape are real and devastating.

It is by no means a woman's fault because she dresses provocatively. Every time I hear a story like this it infuriates me. I remember having to study a few cases about rape while I was at uni, this nut job judge let two rapists off because the women were wearing short skirts.

It is the MEN that rape with the problem, their disgusting and immoral needs and lack of respect for another person.

I really couldn't care less if the woman is dancing around naked shaking her butt in the air, if she says no for whatever reason, it god dam means NO!

I can't even think of anything to say that would make any difference in this matter. I can however thik of a few choice words for that judge though. What a horrible day for that poor women to hear those words come out of that judges mouth My heart would have dropped and i would have died. That is completely wrong of the judge to say because a women dresses inappropriately that the peson who raped her can go free what does that say to every women out there that dresses like that its sayng hey if u get raped its your fault because your asking for it..when did no means no start meaning no means yes.

That was the other thing I was thinking - I'm married so isn't there even more expectation there? If we go out for dinner and I'm all dressed up and have a couple of glasses of wine and then don't feel well later, is sex in the air so he can just go for it? I mean really. My husband would never say that he's entitled at that point. He can control himself. And we're in a freaking relationship so there actually is a REAL expectation there. I'm sure this judge would never send anyone to jail for spousal rape.

I think the really scary thing is when you start reading the comments on these things and you find out how many people there are who actually agree with the stupid judge. I guess some guys get a little miffed that the attractive women at the clubs don't actually want to sleep with them so they lay the blame on the ladies. What kind of mothers raised their sons to think this way? Man, back in the day I used to wear some ummm...interesting things. Things I certainly wouldn't wear today. And I would have a couple of drinks at the bar. I had a boyfriend the whole time and obviously no interest in having sex with anyone else. Could this have been me?

Wow! so I guess the hundreds of coeds who visit my border city downtown are asking for it! That describes exactly how all of them dress. Calling all pervs, it's a free for all! As long as she's dressed skankily enough.

So if I dress in the typical DT attire and I am innocently flirting with some dude, it is completely in his legal right to rape me? And if I kiss him or *naughty naughty* make out with him then that gives him the right to force his penis inside me possibly injecting me with STDs and inpregnating me. This is why we still have rapists running around. We let them. We fail to understand the crime, we blame the victum, we give perps permission to act as they do, we look the other way, we make excuses for them .... we say we hate this crime, but really???
